What Rabbi Menken said in the video is true, but the bigger issue that the “Respect for (Same Gender) Marriage Act” is not sufficiently stressed in that video.
Namely, recognition by Democratic Vote of Same Gender Marriage for the Entire U.S.A. brings us one step closer to the sin threshold that brought about the Divine Decree of World Destruction by the Biblical Flood.
As it says (Rabbi Aryeh Kaplan translation) to the end of Genesis Ch. 6 verses 5 – 13
5 God saw that man’s wickedness on earth was increasing. Every impulse
of his innermost thought was only for evil, all day long. 6 God regretted that
He had made man on earth, and He was pained to His very core. 7 God said,
“I will obliterate humanity that I have created from the face of the earth—
man, livestock, land animals, and birds of the sky. I regret that I created
them.” 8 But Noah found favor in God’s eyes.
9 These are the chronicles of Noah:
Noah was a righteous man, faultless* in his generation. Noah walked with
God. 10 Noah fathered three sons: Shem, Ham and Yefeth.
11 The world was corrupt* before God, and the land was filled with crime.
12 God saw the world, and it was corrupted. All flesh had perverted its way on
the earth.
13 God said to Noah, “The end of all flesh has come before Me. The world
is filled with [man’s] crime. I will therefore destroy them with the earth.

By Criticizing – Biden’s Defense of Same Gender Marriage Act, by stating a technical objection; namely, that the law can empower “Bad Actors” to persecute the Jewish Community by making them pay costly legal expenses over frivolous accusations, it makes it sound (to the uneducated), if that problem could be solved, Same Gender Marriage would be okay, when it is not.
In the long run any conditional approval of LGBT Laws (such as, “I will tolerate it, if you can stop frivolous accusations against Jews”) will undercut support for allowing any religious exceptions to those laws, since a religious viewpoint that the mainstream feels is completely ridiculous on moral grounds, will not be respected. Experience shows that appeals to the “Freedom of Religion” amendment in the USA constitution will not be honored when the mainstream strongly opposes an aspect of the minority religion. More effort has to be put into showing the mainstream, why our moral position is indeed reasonable and as a byproduct we will be freed from persecution.
